Nomination Application

The following document checklist is based on the Departments public guidelines and should be tailored to your specific circumstances by a lawyer - registered migration agent. As a client of U migrate Australia, we provide a tailored checklist for you, as your situation requires.

 

Australian Business Number (ABN) registration certificate (if you are an Australian-based employer).

Australian Registered Body Number (ARBN) registration certificate (if you are an overseas business registered to operate in Australia).

Business Names Details extract from Australian Securities and Investment Commission's (ASIC) business name register.

Australian Securities and Investment Commission (ASIC) company extract (listing registration details for the Australian Company Number)

Australian Stock Exchange (ASX) listing registration (if applicable).

Relevant pages of the trust deed (pages listing parties to the trust and the signature page)

Relevant pages of the franchise agreement (pages listing the parties to the agreement and the signature page).

Relevant pages of the joint venture agreement (pages listing the parties to the joint venture and the signature page).

If operating over a number of years: recent financial reports (profit and loss statements, and annual report for the most recently concluded financial year)

If you are a recently established or small business: business tax returns for the most recently concluded financial year; recent business activity statements (BAS); and recent bank statements

A detailed business plan

Contracts to provide services

Contract of sale relating to the purchase of the business, where settlement has occurred

Lease agreement relating to business premises

Evidence of employment of staff

Business activity statements (BAS) for each complete quarter from commencement of operations to date of lodgement.

If trading for 12+ months, training receipt(s) for relevant payments / employment contract(s) for relevant employee(s)

If trading for under 12 months, Auditable Training Plan

Employment Contract - signed and dated by both parties and either ongoing, or for the period requested in the SBS

Relevant contracts and payslips for Australian employees undertaking the same work in the same location

Any agreements or instrumenst that apply to the nominated position

Enterprise agreements that will apply to the nominated position

Enterprise agreements for staff performing the equivalent work with other employers

Similar job vacancy advertisements - duty statements

References to the Australian Bureau of Statistics survey of Employee Earnings and Hours

Evidence of LMT from within the previous twelve months prior to lodging a nomination

Receipts of any fees paid for job advertising

References to research published in the last four months relating to labour market trends generally and in relation to the nominated occupation

Expressions of support from Commonwealth, state or territory government authorities with responsibility for employment matters

Details of the results of your recruitment attempts including details of any positions filled as a result.

Evidence of your nominee working for an associated entity in Brunei, Myanmar, Cambodia, Indonesia, Laos, Malaysia, Philippines, Singapore, Thailand, Vietnam, Chile, China, Japan, Korea or New Zealand

Genuine position statement to support and verify the nominated position exists and is what it purports to be

A duty statement that includes the responsibilities of the nominated position – note: duties should not just be 'copied and pasted' from ANZSCO;

A structure chart for the business including full names of current employees and details of any visa held, which indicates how the position fits into the business activities;

Evidence that the position existed in the business prior to lodgement of the nomination

If the position is newly created, whether there are any related plans for the expansion of the business

Advice / confirmation from a relevant Regional Certifying Body (RCB)

 

Requirements

You should provide copies of your original documents in high quality, full colour .pdf files. Original documents should be scanned with a flat-bed scanner - not a phone or camera - ensuring

  1. Single page documents are scanned into one (1) .pdf file;
  2. Multiple page documents are all scanned into one (1) .pdf file;
  3. All .pdf files are named appropriately to identify the content, for example: James birth certificate.

Certified Copies
